What estate planning covers
A well-built estate plan is more than a will. It's a coordinated set of documents that lets you direct who gets what, when, and under what conditions — with the least friction for the people you love. PLDR drafts each piece carefully and reviews how they interact.
Core lifetime & death documents
- Last will and testament — directs distribution of probate assets, nominates executor and guardians for minor children
- Revocable living trust — when probate avoidance, control over distributions, or incapacity planning calls for it
- Durable general power of attorney — financial decision-making during incapacity, under Virginia's Uniform Power of Attorney Act
- Advance medical directive — healthcare decisions when you can't speak for yourself, including end-of-life preferences (Va. Code § 54.1-2981 et seq.)
- HIPAA authorization — so the right people can access your medical information when needed
- Beneficiary designation coordination — retirement accounts, life insurance, payable-on-death accounts
Specialized planning
- Special-needs trusts for beneficiaries with disabilities, preserving public benefits eligibility
- Irrevocable trusts for estate-tax planning or asset protection
- Charitable giving planning (charitable remainder trusts, donor-advised funds, direct bequests)
- Multi-generational and dynasty planning for family businesses and farms
- Premarital planning coordinated with prenuptial agreements
Estate & trust administration
- Probate qualification and administration through the local circuit court
- Trust administration outside probate
- Inventories, accountings, and Commissioner of Accounts filings
- Beneficiary communications and disputes
- Final fiduciary tax returns and coordination with CPAs
Why plan now
Without a will, Virginia's intestate succession statutes (Va. Code § 64.2-200 et seq.) decide who inherits and in what proportions. Without a power of attorney, a sudden incapacity can mean court-supervised guardianship and conservatorship. Without an advance directive, healthcare decisions fall to whoever is available, sometimes against your wishes.
PLDR's team is direct about what you need — and what you don't. Most clients don't need an elaborate trust structure. Some do. The first conversation is about finding out which category you're in.
Central Virginia estate considerations
Estate planning for Central Virginia families often involves elements that out-of-region planners overlook: family farms and timber tracts held across generations; closely-held businesses with adjacent real estate; multi-state property (especially for clients with second homes at Smith Mountain Lake or in the mountains); and inherited land with complicated chains of title. PLDR's Lynchburg office sees these issues regularly and plans around them.
Where PLDR files and administers estates
PLDR's Lynchburg office at 925 Main Street, Suite 300 regularly qualifies estates and administers trusts in the Lynchburg Circuit Court and the circuit courts of Campbell, Amherst, Bedford, Appomattox, and Prince Edward counties — working closely with each jurisdiction's Commissioner of Accounts.
